Terms and Conditions

Promotion Summary:

1.1 The Promotion allows the participants to win two (2) return Eco Bird Fare tickets, valid for flights available for sale on Freebird Airlines' website. Please note that travel only applies on Freebird Airlines (‘PROMOTER’) operated aircraft (Please refer to section 2.2 for restrictions on travel dates).

Please note that this prize is non-transferable, exchangeable, has no redeemable cash value. NO PURCHASE OR PAYMENT IS NECESSARY IN ORDER TO ENTER. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.

Conditions:

2.1 The Winner and the Winner’s chosen travelling companion (‘Companion’) are responsible for and must cover the cost of:

visas, passports and any other travel documentation required;
transport and associated costs from their residence to their selected airport for flight departure and from their selected airport to their residence upon returning.
all other expenses related to the Prize, including without limitation taxes, full travel insurance, transfers, accommodation, spending money, food and beverage and any other incidental costs; and any changes to travel dates.
compliance with the entry regulations of the respective destination.

2.2 Travel Period: The prize can be redeemed based on availability and outside of vacation periods until the end of the summer 2025 schedule. Flights during Easter, as well as in July, August, and October, are excluded.

2.3 The Winner and Companion must travel together at all times within the travel period. The dates for travel beyond those noted in clause 2.2 and 2.3 are subject to availability. The Winner may not get preferred dates. Freebird Airlines reserves its right to impose particular flight embargoes during periods of heavy demand as is required commercially from time to time.

Specific Rules:

3.1 The Winner and Companion must hold full international travel insurance for the duration of the trip prior to departure from their departure airport.

3.2 If the Winner or Companion has a criminal record and is denied entry into Turkey or encounters any visa issues on route, Freebird Airlines cannot be held responsible or liable in any way.

3.3 The provision of air tickets from Freebird Airlines is subject to the following conditions:

the issuance of tickets is subject to clause 2.2 and 2.3;
excess baggage waiver will not be granted;
the tickets will only be issued if all sectors are confirmed;
once the airline tickets are issued to the Winner and Companion, requests for changes of passengers’ names and travelling sectors will be subjected to Freebird Airlines approval. For any changes to tickets after issuance a charge per change could be levied;

3.4 Please visit https://www.freebirdairlines.com/information-for-flight for information about your ticket fare and other travel-related inquiries. Charges for excess baggage shall apply where a passenger seeks to carry more than their entitlement of luggage. In such cases, Freebird Airlines is not liable for the charges.

3.5 Tickets will be valid only for the travel as specified and for the period specified on the ticket. Unused travel at the expiry of the validity period cannot be refunded or re-utilized. Once a journey commences (i.e. the point at which the first flight coupon is redeemed for travel), the utilization of the commitment for free tickets is deemed to have been made against the provision stated above.

3.6 Tickets are not transferable and must be issued only in the correct name of the person travelling.

3.7 The Prize must be taken as stated in these terms and conditions and no compensation will be payable if the Winner is unable to use the Prize as stated. For the avoidance of doubt, if the Winner is, for whatever reason, unable to travel on a nominated date during this period, whether the failure was due to reasons beyond the Winner's control or otherwise, then the Winner will forfeit the Prize.

Winning the Prize

4.1 The Winner may be invited to participate in publicity activities related to the Promotion, subject to their consent.

4.2 The Winner accepts the Prize entirely at their own risk. Except in case of death or personal injury or damages arising from gross negligence or willful misconduct and so far as is permitted by the Warsaw Convention and the Montreal Convention, Freebird excludes responsibility and all liabilities. This limitation of liability also extends to breaches of duty by our legal representatives or vicarious agents.

4.3 The Promoter makes no representation as to safety, conditions and other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the departure/arrival of Foreign Affairs and Trade.

4.5 The Winner and Companion must sign a legal release, in a form acceptable to the Promoter in its absolute discretion, if requested by the Promoter.

Privacy and Privacy Policy

5.1 By participating, entrants grant Freebird Airlines exclusive permission to use their names, characters, photographs, videos, voices and likeness in connection with the Promotion and for future promotion and marketing purposes and waive any claims to royalty, right or remuneration for such use.

5.2 All participants personal details must be valid and up to date and will be held by Freebird Airlines, subject to each entities privacy policy and may be used for the purpose of the Promotion and for future promotional and marketing purposes.

5.3 Personal information provided at the time of entry is presumed to be true and, in the case of text or email notification – active, through to and beyond the date of the Promotion’s completion.

5.4 The Participant agrees that the Promoter may collect, use and disclose the participant’s name, details and personal data (including photographs, audiovisual and other recordings) for the following purposes: to communicate with the Participant for the purposes related to the Competition, to provide goods and services to the Participant upon request, to send e-newsletters and messages relating to news, products and services, for publicity (whether to promote the Competition or otherwise) and for other matters for which the Participant has provided the Promoter with consent, without further notification, remuneration or compensation.

General and Liability

6.1. The Promoter reserves the right to amend, vary, extend or discontinue a Promotion at any stage, for any reason.

6.2. The Promoter takes no responsibility for any inability to enter, complete, continue or conclude the Promotion due to equipment or technical malfunction, busy lines, misspelt email address, Acts of God or otherwise.

6.3 Freebird accepts no liability to any person for any personal injuries, liabilities, losses, claims, demands, costs or expenses arising directly or indirectly out of participation in the Promotion or winning the price, except in accordance with and subject to the limitations set out in the Warsaw Convention and the Montreal Convention.

General Conditions of Travel

7.1. The Prizewinner and their Companion are expected to observe the following conditions as part of the utilization of travel:

Be neatly and appropriately attired when traveling.
Not carry, on their person, in their luggage or carry-on baggage, any contraband or goods which are prohibited by the laws of departure country or the country of their final destination, or goods which are unsuitable for carriage on a commercial aircraft.
Observe all directions of Freebird Airlines ground staff and air crew at all times.
Comply with the requirements of immigration and customs authorities in each country.
Take responsibility to pay any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities (including any costs with delay)
Comply with the laws of the jurisdiction they are visiting
The Prizewinner and their Companion must organise their own visas and requisite travel documentation (such as relevant valid international drivers’ licenses) for trips and any visa or passport charges are their sole responsibility. The Prizewinner must obtain and hold travel insurance for the entire duration of their travel. The Prizewinner must not do anything to void their travel insurance.
The Prizewinner must at all times act in good faith and must not act in any way that would bring the Promoter into disrepute.
The Promoter reserves the right to change and vary the Prize at any time and may substitute any Prize for an alternative Prize of similar value without any prior notice. The value of the Prize will be solely determined by the Promoter.
The Promoter cannot be held responsible for the Prizewinner and/or their Companion being unable to participate in the travel Prize due to visa or other restrictions. Any fines, penalties, payments or expenditures incurred as a result of such travel documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s. At all times, it will be the responsibility of the traveller to ensure that their passport is in order and that they have the necessary visa clearances to enter the country of destination and, if required, any transit point.
Flights associated with the plane tickets allocated to the winner by Freebird Airlines may be canceled or rescheduled by Freebird Airlines. In such cases, Freebird Airlines is not obligated to provide compensation. Alternative flights may be offered for canceled flights, or if the new schedule of a rescheduled flight does not suit the winner, another flight may be proposed. However, if these alternative flights are deemed unsuitable by the winner, Freebird Airlines is not obligated to provide any additional tickets to the winner. Additionally, Freebird Airlines is not liable to pay compensation for any delays that may occur during the flights.

Miscellaneous

8.1 The Promoter reserves the right to disqualify any individual who breaches any of these terms and conditions, acts in a fraudulent, dishonest or disruptive manner, or otherwise than in accordance with the spirit and intent of this Competition or is involved in any way in interfering or tampering with the conduct of this Competition.

8.2 By entering this Competition or accepting a Prize, the Participant and their Companion agree to indemnify, release and hold harmless each of the Promoter, its related companies, its parent company, affiliates, directors, officers, employees and representatives, in accordance with and subject to the limitations set out in the Warsaw Convention and the Montreal Convention, against any and all liability, losses, demands, claims, actions, damages (including special, indirect and consequential damages), costs and expenses arising from or incurred, directly or indirectly, as a result of the Participant’s entry into the Competition and acceptance, possession, use or misuse of the Prize, including personal injuries, death and damage to personal or real property, due in whole or in part.

8.3 The Promoter reserves the right to amend these Terms and Conditions, either wholly or in part, including the right to cancel this Competition, in such manner as it deems fit, without prior notice or reason, and without liability to such Participant or Prizewinner.

8.4 In the event of any inconsistency between these Terms and Conditions and any brochures, marketing or promotional materials relating to the Competition, these terms and conditions, and all its subsequent variations, shall prevail.
